2. Registration and conclusion of the contract

The training offers of trendig are subject to confirmation and non-binding.

The registration of a course participant for a course can only take place in a binding manner via the website or, in acknowledgement of these general terms and conditions of business, in writing, by email or by fax. The booking shall not be deemed to be binding until a written confirmation of the registration of the participant has been issued by trendig. The confirmation of the registration shall not lead to a legal claim to the performance of the course.

The number of participants for each course is limited for didactical and organisational reasons. Registrations will be considered on a first-come, first-served basis.

3. Services

The sum stated in the course description is the participants’ fee for the course which must be paid. All learning aids and documents, as well as the use of the software for the duration of the course, are included in the participants’ fee. In addition, the participants of our open courses will be provided with lunch, refreshments during breaks, snacks, as well as soft and hot drinks during the sessions.

14 calendar days prior to the start of the course, trendig will inform the course participants in a binding manner of all details connected to the course, such as location, start times, teacher and any technical equipment which the participants must bring with them.

Depending on the course type, a final examination can take place after the course. This examination will either take place at the course location directly, or at a test centre located close by. As a rule, the examination which follows the course will also be booked in a binding manner by means of the reservation, unless such a provision is expressly omitted. This fee will be charged together with the course fee.

Please remember to bring a valid identity card or passport for the examination.

For certain certificates, it is possible to receive a discount on the examination fee as an ASQF member. In order to claim this, it is necessary to notify trendig of the ASQF membership number 14 calendar days prior to the start of the course at the latest.

Expenses of the participants for certain examination fees, travel to and from the venue, accommodation or transfers to the course location are not included and will be charged for separately, should these be booked through trendig.

4. Booking alteration

Booking alterations must, as a rule, take place in writing, by email or fax to the point of contact stated in §1. Booking alterations can be made up to three times.

Following the confirmation of the registration by trendig, the client can nominate a replacement participant prior to the final working day before the start of the course. Such booking alterations are free of charge.

Up to 28 calendar days prior to the start of the course, no fee will be charged for a book- ing alteration to a different date. Should a booking alteration take place between 28 and 15 calendar days prior to the start of the course, a fee of 25 % of the participants’ fee will be charged. In case of booking alterations 14 calendar days or fewer prior to the start of the course, 50 % of the participants’ fee must be paid.

In case of a booking alteration, the price which applied to the original course registration shall continue to be in force.

For clients that require more flexible rebooking options, trendig provides a flexible booking tariff, which will be regulated in a separate contractual agreement.

5. Cancellation

Legally valid cancellations must, as a rule, also take place in writing, by email or fax to the point of contact stated in §1.

Up to 28 calendar days prior to the start of the course, no fee will be charged for a can- cellation. Should a cancellation take place between 28 and 15 calendar days prior to the start of the course, a charge of 50% of the participants’ fee will be payable. In case of cancellations within 14 calendar days of the start of the course, the full price must be paid. In case of non-appearance or should the participant not attend the whole course, the participants’ fee must also be paid in full.

For organisational reasons, trendig reserves the right (for example in case the minimum number of participants of 3 is not reached or due to hindrances outside of its control) to cancel individual courses. In exceptional cases (for example, should the teacher be ill or in case of force majeure), the cancellation can take place at short notice. In case of cancellation on the part of trendig, it will endeavour to rebook the participants to another location or date with their agreement. Otherwise, the participants’ fees which have been paid until this time will be refunded in full. Any legal claims which go beyond the above, in particular to the reimbursement of the costs due to loss of work time, travel or hotel costs, shall not exist.

6. Deviations during performance

trendig reserves the right to carry out changes to the schedule, course location, the teacher and minor alterations to the course materials for important reasons. Course contents can, to this extent, deviate in terms of content from that set out in the offer and/or on the website, if this is considered prudent at short notice according to the expertise of trendig in order to update the contents of the course so as to offer an improved training experience to the participants. trendig is entitled to provide replacement teachers in case of absence or loss of personnel. Date and/or location changes for important reasons will be announced in good time, at least 5 working days prior to the start of the course. Should a participant not be able to join the course as a result, he or she can rescind the contract free of charge. Any claims which go beyond the above shall be excluded.

7. Fees

For the registration of larger groups of participants within 12 months, trending offers framework contracts which include a bulk discount. These separate agreements require written form and cannot be combined with other offers of trendig.

For in-house courses at the premises of the client, trendig offers special in-house contracts. Such separate agreements require written form.

8. Due dates

The participants’ fee for attending a course is due for payment 14 calendar days prior to the start of the course without deduction.

The first warning following the client entering payment default is free of charge. For each subsequent warning, a EUR 5.00 warning and processing fee and default interest to the statutory amount will be charged.

9. Liability

To the extent that is legally permitted, trendig rejects any liability for itself or its employees, except in case of intent or gross negligence. In particular, losses which are incurred due to computer viruses are also excluded.

The participant who is responsible shall incur liability for damage to software, hardware or equipment.

For certain courses, trendig uses open-source software. This product produced by the community is not free of errors and may hinder the seamless performance of the course. In such cases, trendig teaches the know-how without practical exercises or with the remaining practical exercises. No legal claim exists to a reduction of the participants’ fee for such reasons.

10. Copyright and other rights

All rights in relation to the materials, documents, software, hardware, etc. provided or used during the course remain with trendig in full. In particular, the right of reproduction and duplication of the training documents in full or in part is reserved by trendig. trendig merely grants the course participant a non-exclusive, non-assignable right of use for the purpose of learning. No parts of the training documents or the software used in the course which is protected by copyright or trademarks may be processed, duplicated, distributed or publicly reproduced in any form without the written permission of trendig. The participant shall be obligated not to copy any software or take this away from the course location.

11. Applicable law and place of jurisdiction

Berlin shall be deemed to be the place of jurisdiction for all disputes connected to the registration for or participation in courses of trendig. The law of the Federal Republic of Germany shall apply.
